A 15-year-old accused of shooting a Village Pantry worker will be tried as an adult.
A juvenile court judge made the ruling Friday
Brandon Payton is accused of shooting 45-year-old Marci Birnell while she was working the overnight shift at the Village Pantry at 86th and Ditch last year.
She is in a rehabilitation center recovering.
If convicted, Payton could get up to 35 years in jail.
